PLEASE READ THIS SINGLE USER LICENCE AGREEMENT FOR LINEBUILDER CAREFULLY: This licence agreement ("Licence") is between You and the European Organization for Nuclear Research ("CERN") and governs your use of LineBuilder (as defined below).
1. Definitions
Modifications means any changes, enhancements, adaptations, translations, abridgements, condensations, revisions or re-writes of LineBuilder. “Modifies” and “Modified” shall be interpreted accordingly;
Line Builder means the Python programme, consisting of multiple Python modules, for assembling complex FLUKA.CERN geometries of accelerator beam lines, available from https://fluka.cern/, as well as any Modifications and the accompanying documentation;
Use means to download, install, copy, access or otherwise use LineBuilder. “Using” shall be interpreted accordingly;
You means the individual user licensing LineBuilder under this Licence. “Your” shall be interpreted accordingly.
2. Licence Grant
CERN hereby grants You a personal, non-transferable, non-sublicensable, non-exclusive, royalty-free source code licence to Use and Modify LineBuilder solely for internal, scientific, non-commercial purposes. You shall Use LineBuilder in good faith, in compliance with best practices, professional standards, and all applicable laws.
3. Technical Assistance and Reporting
CERN may provide support through the FLUKA user forum available at: fluka-forum.web.cern.ch (“FLUKA User Forum”). You shall report any errors or bugs concerning LineBuilder to the FLUKA User Forum as soon as possible.
4. Modifications
If You believe that Your Modifications to LineBuilder could be of general interest and, therefore, worth considering for the future releases of LineBuilder, please submit them to https://fluka.cern/form/contact.
5. Restrictions
You must not Use LineBuilder for any military purposes, make it available to a third party, or remove, modify or alter the relevant copyright notices or LineBuilder documentation.
6. Acknowledgement
Any publication or communication related to the Use of LineBuilder shall duly acknowledge its Use, mention that CERN is the copyright holder of LineBuilder, and cite the reference (i.e. Use of the LineBuilder must be acknowledged using the following reference) available at https://fluka.cern/documentation/references#linebuilder.
7. Warranties and Liability
LineBuilder and any technical assistance are provided “as is”, and CERN does not provide any express or implied warranties of any kind concerning the same, including but not limited to non-infringement of rights of third parties, merchantability, satisfactory quality or fitness for a particular purpose. CERN does not provide any warranties regarding the continuous or future provision of LineBuilder, any update or new version, or any technical assistance related thereto.
CERN does not accept any liability whatsoever for direct, indirect, special, incidental, consequential, exemplary, punitive or other damages of any nature including, without limitation, damages for loss of data, or interruption of activities, arising out of or related to (i) Your Use of or inability to Use LineBuilder, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if CERN has been advised of the possibility of such damages, or (ii) Your non-compliance with laws and export control regulations. You shall hold CERN free and harmless from and indemnify it against all claims and liability regarding the subject matter of this section.
8. Termination
The Licence is effective upon Your acceptance of the terms of the Agreement or upon Your Use of LineBuilder and shall remain in effect until terminated. CERN may terminate the Licence immediately upon written notice if You breach any of its terms. Upon termination of the Licence You must cease any Use of LineBuilder and destroy all copies thereof. You agree to provide a proof of destruction if requested so by CERN. Sections 5 (Restrictions), 6 (Acknowledgement), 7 (Warranties and Liability), and 9 (Disputes) shall survive the termination of the Licence.
9. Disputes
The terms of the Licence shall be interpreted in accordance with their true meaning and effect, and independently of any national or other laws. Without prejudice to CERN’s status as an Intergovernmental Organization, reference shall be made to Swiss substantive law where: (a) a matter is not specifically covered by this Licence; or (b) a term of this Licence is ambiguous or unclear. Reference to Swiss substantive law shall be made exclusively for the matter or the term concerned and shall in no event apply to the other terms of this Licence.
Without prejudice to CERN’s international legal status, if any dispute under the Licence fails to be settled amicably, such dispute shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce (ICC). Unless agreed otherwise in writing by the Parties, any dispute shall be settled by three arbitrators, in English and take place in Geneva. Neither the arbitral award nor any procedural order made in the arbitration shall be published or its contents made known to any third without the prior written approval of each Party. Any deadline or timeline falling in or incorporating CERN's end-of-year closure in whole or in part shall be deferred or suspended by a period equal to such period of closure.
